First Appearance

The first court appearance after the police release you or you are released on bail is called a “First Appearance.”

First Appearance Checklist:

  • Bring all paperwork from your release.
  • Arrive at least 15-30 minutes early.
  • Check the docket, the list of matters in court today, to find your courtroom.
  • Put your name on the list to speak with Duty Counsel (a free lawyer) before you go into the courtroom.
  • Sit in the public seating area and wait for your name to be called.
  • When your name is called, stand at the front center of the public seating area or at the podium.
  • You will be asked to state your full name and date of birth. Example: “John Doe, May 31, 1990”
  • Make sure to speak clearly and loud so that you can be heard. You must respond to all questions using your voice, not nodding.
  • You will be provided with your Disclosure Package.
  • This includes all of the information that the Crown Attorney has on your case as well as a Charge Screening Form.
  • You will be given a next court date in order to review your disclosure and decide if you will retain a lawyer.

Case Study

Derek and group home staff attend court for his first appearance and receive his disclosure package.

His matter is adjourned four weeks to allow him to review his disclosure package and see if he is eligible to apply for Legal Aid Ontario.
